ZAKLJUČCI SUBREGIONALNE KONFERENCIJE IMF-a

PO PITANJU NESIGURNOG RADA

 

 

 

            Subregionalna Konferencija IMF-a za Jugoistočnu Evropu na svom sastanku od 13-14.Septembra 2007 godine je raspravljala po pitanju nesigurnog rada. Iz opšte diskusije se moze zaključiti da je vidjenje ovog problema u zemljama JIE isto ili slično, razlike su male.  Razlozi za ovakvo stanje leže u zakonodavnom djelu, tranziciji društva i privrede u kojoj se zemlje JIE nalaze, privatizaciji, velikom procentu nezaposlenosti, niskom standardu i niskim zaradama, kao i nedovoljno razvijenom sindikalnom pokretu, nefunkcionisanju pravne države i visokom nivou korupcije.

 

            Kao posljedica ovakvog stanja stvari, sindikati se suocavaju sa padom članstva, a samim tim i sa padom uticaja u društvu i medju radnicima.

 

Ovakvo stanje koriste poslodavci i pribegavaju zapošljavanju na odredjeno vreme, odnosno na ovaj način vrše zamenu stalnih ugovora sa ugovorom za povremene i privremene poslove.

 

            Velika stopa nezeposlenosti i mali broj radnih mesta dovodi do toga da bi radnici prihvatili bilo kakav posao, cak i takozvanu fleksigurnost, iako to nije rješenje njihovog problema. S tim su radnici izloženi stalnim pritiskom poslodavca i njegovim prijetnjama da im se ugovor nece produžiti.

 

            U ovakvoj situaciji, problem nesigurnog rada još više pojačava ekonomsku nestabilnost, doprinosi nepostizanju održivog razvoja i vodi u jedan začarani krug u kojem se situacija potpuno izmiče kontroli, a sindikati se sve više udaljavaju od procesa pregovaranja i mogućnosti uticaja na stvaranje socijalno-odgovornog društva.

 

            Činjenica je da se svi problemi i posljedice nesigurnog rada jače odražavaju na žensku radnu snagu, gdje sindikati treba da posvete posebnu pažnju.

 

            Sindikati članice IMF-a saglasni su da je ovakvo stanje velika prijetnja sindikalnom pokretu i vodi ka slabljenju njegove pregovaračke pozicije, što će dovesti do ugrožavanja procesa kolektivnog pregovaranja i postojanja kolektivnih ugovora.

 

            Sindikati JIE u potpunosti podržavaju IMF-ovu globalnu akciju protiv nesigurnog rada i zaključuju da je neophodno:

 

-          permanentno i kontinuirano organizovanje radnika;

-          konstantno informisanje radnika i članstva o aktivnostima sindikata;

-          podizanje svesti svih radnika, bez obzira na članstvo u sindikatu, a posebno žena, o njihovim pravima;

-          javni nastupi u medijima po svim temama bitnim za položaj zaposlenih;

-          pritisak na vlade za poboljšanje zakonske regulative u smislu izjednačavanja i unapredjenja prava svih zaposlenih, kao i eliminisanje svih oblika diskriminacije;

-          sindikati moraju insistirati na donošenju kolektivnih ugovora na nacionalnom nivou, koji će se odnositi na sve zaposlene;

-          ukoliko postoje statutarne prepreke za organizovanje radnika sa nesigurnim statusom, te prepreke se moraju HITNO OTKLONITI;

-          statuti sindikata se tagodje moraju prilagoditi pozitivnoj diskriminaciji po pitanju polozaja žena i mladih u sindikatu.

-          preduzeti neophodne korake kako bi se preporuka MOR-a R198 pretvorila u konvenciju;

-          pod okriljem medjunarodnih sindikalnih asocijacija, uložiti posebne napore u pravcu jačanja medjunarodne sindiklane solidarnosti i jedinstvenih nastupa prema nadležnim institucijama po ovom pitanju, kako u svijetu, tako i na nacionalnom nivou.

 

Sub-regionalna Konferencija IMF-a za JIE preporučuje ove zaključke Centralnom Komitetu IMF da ih uzme u obzir prilikom razmatranja strategije za sprovodjenje globalne akcije protiv nesigurnog rada. Sindikati iz ovog regiona su spremni da aktivno učestvuju u sprovodjenju ove strategije.

CONCLUSIONS

 

The Sub-regional Conference of IMF for SEE on the meeting from September 13-14.2007 discussed the issue of precarious work. From the general discussion the impression is that the comprehension of this problem in the countries of SEE is similar, and the differences are minor. The reasons for this situation can be located in the field of legislation, the transition of the society and economy in which those countries are, privatization, high level of unemployment, low standard and minimal wages, as well as the underdeveloped trade union movement, malfunction of the legal institutions and high level of corruption.

 

As a consequence to this situation, the unions are facing diminishing of membership, and with that diminishing of their influence in the society and among the workers.

 

The employers take the advantage of this situation and mostly use precarious forms of employment in the way that they change the permanent with temporary contracts, outsource and subcontract.

 

The high level of unemployment and limited number of jobs leads to situation where the worker would accept any kind of job, even the so-called flex-security. This is not a solution to their problem. With all this, the workers are exposed to constant pressure from the employers that their temporary contracts will not be continued.

 

In such situation, the problem of precarious work contributes to further strengthening of the economic instability, not achieving of sustainable growth and leads into a vicious circle in which the situation is completely getting out of control and the unions are more and more put aside from the process of negotiations and the possibility to influence creating of socially-responsible society.

 

Fact is that all problems and consequences of precarious work affect more severely the women workers, therefore the unions have to pay more attention to this issue.

 

The unions members of IMF agree that this situation is huge treat to the union movement and leads towards further weakening of the collective bargaining process and diminishing the rights provided by the collective agreements.

 

Therefore, the unions from SEE fully support the IMF global action against the precarious work and conclude that it is necessary to:

 

-          permanently and continuously organize the workers;

-          constantly inform the workers and members about the union activities;

-          raise awareness of all workers, regardless the union membership, and particularly women, about their rights;

-          public campaigns and reports in the medias regarding all issues important for workers’ status;

-          put pressure over the governments for improving the legal regulations in direction of equalizing upward the rights of all employees and eliminating all kinds of discrimination;

-          the unions must insist on bargaining collective agreements on national level applicable to all employees;

-          if there are statutory obstacles for organizing workers on precarious jobs, they must be removed at once;

-          the statutes of the unions have to integrate the positive discrimination regarding the position of women and young in the unions;

-          take necessary steps towards transforming the ILO Recommendation R198 into ILO convention;

-          put special efforts, under the umbrella of  IMF, in strengthening the international union solidarity and synchronizing the activities about this issue on global and national level.

 

The IMF Sub-regional Conference for SEE recommends IMF Central Committee to take those conclusions into consideration when formulating the global strategy against the precarious work. The unions from this region are ready to take active part in implementation of such strategy.
